1. Introduction

Welcome to BalancedLifestyleClub ("us," "we," or "our"). The following Terms & Conditions ("Terms") control the use of our yacht hiring services and the website situated at balancedlifestyleclub.sbs (the "Service"), which is provided by BalancedLifestyleClub.

When you arrange a charter or utilize our Service, you agree to comply with these Terms. Should you not agree with any section of these terms, you are prohibited from using the Service.

2. Service Overview

BalancedLifestyleClub offers exclusive yacht hiring services that cover a range of activities including but not restricted to:

• Daylong yacht hires
• Evening voyages
• Business getaways
• Exclusive celebrations
• Extended charters

We hold the right to adapt or stop services at any given time based on availability and climatic conditions.

3. Booking and Reservations

3.1 Booking Process

To reserve a charter, you are required to:

• Attain a minimum of 18 years of age
• Supply correct and comprehensive information
• Render the necessary deposit as stated in your reservation confirmation
• Consent to these Terms & Conditions

3.2 Confirmation

A booking becomes confirmed only after we receive the payment and issue a written confirmation. We hold the right to decline service to any person at our sole discretion.

3.3 Availability

All charters depend on the vessel's availability and appropriate weather conditions. We put in earnest attempts to accommodate your preferred schedule.

4. Payment Terms

4.1 Pricing

All rates are provided in € and cover all applicable taxes unless stated otherwise. Prices may be adjusted without prior notice.

4.2 Payment Schedule

• Deposit: A payment of 50% of the whole charter cost at the time of reservation
• Final Payment: Required 48 hours before the charter's departure
• Any additional costs (if applicable): Payable after the conclusion of the charter

4.3 Payment Methods

We accept primary credit cards, bank wire transfers, and certified checks. All payment processing is done via secure, encrypted channels.

5. Cancellation and Refund Policy

5.1 Customer Cancellations

• If canceled more than 72 hours in advance of departure: Full refund less processing fees
• If canceled between 24 to 72 hours before departure: 50% refund
• If canceled fewer than 24 hours before departure: No refund shall be issued

5.2 Weather Cancellations

In instances where the weather is considered unsafe by our captain, our options will be to:

• Move your charter to an alternative date at no extra charge
• Issue a full refund if rescheduling cannot be accomplished

5.3 Mechanical Issues

If your designated vessel encounters mechanical issues, we will make an effort to offer an adequate substitute. If a substitute cannot be provided, you will be eligible for a complete refund.

6. Safety and Conduct

6.1 Safety Requirements

All guests must:

• Adhere to all instructions from the crew
• Utilize any safety gear when it's required
• Disclose any medical condition that could influence their safety
• Stay within the designated areas on the vessel

6.2 Prohibited Items

The following are not allowed onboard:

• Containers made of glass
• Illegal substances
• Weapons or firearms
• Excessive quantities of beverages (beyond reasonable non-alcoholic drinks like juice or soda)
• Pets (unless prior permission has been granted)

6.3 Conduct

Guests are expected to behave appropriately. Should guests' conduct become a safety hazard or cause disruption, we reserve the right to end the charter early without a refund.

7. Liability and Insurance

7.1 Our Liability

We limit our liability to the cost you pay for your charter. We're not responsible for:

• Injuries arising from personal carelessness
• Theft or damage to personal items
• Indirect, incidental, or punitive damages
• Delays due to weather or situations we cannot control

7.2 Insurance Coverage

Our comprehensive marine insurance provides coverage for our vessels and associated activities. It is your duty to ensure personal and travel insurance.

7.3 Assumption of Risk

By engaging in our yacht services, you accept that maritime activities pose inherent dangers, for which you are assuming full responsibility for your own safety and security.

8. Modifications and Itinerary Changes

We reserve the authority to alter itineraries, paths, or timetables subject to weather, safety, or operational demands. We will take all measures to offer similar alternatives whenever necessary.

9. Force Majeure

We shall not be liable for interruptions, terminations, or modifications stemming from events beyond our direct influence, including but not limited to:

• Extreme meteorological conditions
• Natural calamities
• Regulatory directives
• Port shutdowns
• Unforeseen technical issues

10. Privacy and Data Protection

Your private data is managed in line with our Privacy Policy. Engaging with our services constitutes your approval for the use and collection of your information as outlined within our Privacy Policy.

11. Intellectual Property

All content observable on our website, which includes texts, images, logos, and graphics, is safeguarded by the law, preventing reproduction, distribution, or creation of derivative materials without our explicit authorization.

12. Governing Law

The laws of Germany will govern these Terms. Disputes, if any, shall be settled in the courts of Hamburg, Germany.

13. Changes to Terms

We have the right to revise these Terms when necessary. The amended terms will be posted on our site and bear an updated date of revision. Continued patronage of our services is acceptance of the new terms.
